These Terms and Conditions apply to your use of the House of Badia (“we”, “our”, or “us”) website and to purchases made through our online store. House of Badia is an Ontario, Canada based small business offering original artwork and products featuring our designs through print on demand services.

Our website and online store are intended for adults of legal age. We currently accept orders from customers located in Canada and the United States.

These Terms and Conditions should be read together with our Privacy Policy, Shipping Policy, and Refund & Replacement Policy, which are incorporated into and form part of these Terms. By using our website or placing an order, you agree to these Terms and the policies referenced above.

A) Product Information

We make every effort to accurately display our products, artwork, colours, dimensions, and other details on our website. However, colours may appear differently depending on your screen or device, and minor variations in print placement, colour, dimensions, and other characteristics may occur due to the print on demand manufacturing process. These normal variations are not considered defects.

Product availability may change from time to time, and we reserve the right to modify, discontinue, or update products and designs without notice.

We make reasonable efforts to ensure that product descriptions, images, and prices are accurate. If we discover an error, we reserve the right to correct it and, where appropriate, cancel or adjust an affected order.

B) Intellectual Property

Unless otherwise stated, all artwork, illustrations, designs, graphics, photographs, logos, branding, product images, website content, and text are owned by House of Badia and are protected by applicable intellectual property laws.

Purchasing a physical product grants ownership of that physical item only. Purchasing a physical product gives you ownership of that physical item only. It does not transfer any copyright, trademark, licensing, reproduction, resale, commercial use, or other intellectual property rights.

You may not, without our prior written permission:

• reproduce, copy, or redistribute our artwork;
• create derivative works based on our artwork;
• publish or commercially use our artwork or designs;
• scan, digitize, or reproduce artwork for another purpose;
• manufacture or sell products using our artwork;
• remove copyright or other ownership notices; or
• use our website content, images, or other materials for commercial purposes.

Your purchase does not give you permission to reproduce the artwork on other products, whether for personal or commercial use.

A) Order Acceptance

Your order is accepted only after payment has been successfully authorized and we send you an order confirmation email.

We reserve the right to refuse or cancel any order, including where:

• payment cannot be verified;
• fraudulent or unauthorized activity is suspected;
• product information or pricing contains an error;
• products become unavailable; or
• we are unable to fulfill the order for any lawful reason.

If we cancel an order after payment has been made, we will provide a refund in accordance with our Refund & Replacement Policy.

Please review your order carefully before completing your purchase. Once an order has entered production, changes or cancellations may not be possible.

B) Electronic Communications

By placing an order, you agree to receive electronic communications related to your order, including order confirmations, shipping updates, and customer service responses. These communications are necessary to process and fulfill your order and are separate from optional marketing or newsletter communications.

A) Pricing and Currency

Unless otherwise stated, all prices are displayed in Canadian Dollars (CAD). Applicable taxes and shipping charges are calculated and displayed during checkout before payment is completed.

Customers purchasing from outside Canada may be charged in Canadian Dollars, and their payment provider may apply currency conversion or foreign transaction fees.

We make reasonable efforts to ensure that our prices and product information are accurate. If we discover an error, we reserve the right to correct it and, where necessary, cancel or refuse an affected order. If payment has already been processed, a cancelled order will receive a full refund.

B) Payment Methods

Payments are securely processed through WooPayments using the payment methods available at checkout. We do not store your full payment card details on our website. Payment information is processed and securely stored by our payment provider in accordance with its applicable security and privacy practices.

Our products are made to order through print on demand services. This means that your product is produced specifically for you after your order is placed.

A) Order Changes and Cancellations

Because products are made to order, orders generally cannot be changed or cancelled once production has begun. If you need to make a change or request a cancellation, please contact us as soon as possible after placing your order. We cannot guarantee that changes or cancellations can be made once an order has entered production.

B) Shipping and Delivery

Processing and delivery times are estimates and may vary depending on the product, destination, carrier, and other circumstances. Please see our Shipping Policy for current processing times, shipping costs, delivery estimates, and other shipping information. We are not responsible for delays caused by circumstances outside our reasonable control.

C) Refunds and Replacements

Returns, refunds, and replacements for eligible orders, including products that arrive damaged, defective, or incorrect, are governed by our Refund & Replacement Policy.

By placing an order, you acknowledge that you have read and agree to our Shipping Policy and Refund & Replacement Policy.

You may use the House of Badia website for lawful personal purposes and in accordance with these Terms and Conditions. You agree not to misuse the website, interfere with its operation or security, attempt to gain unauthorized access, or use the website or its content for unlawful or fraudulent purposes.

When using our contact form or subscribing to our newsletter, you agree to provide accurate information and not submit unlawful, abusive, or misleading content.

You may not copy, reproduce, modify, distribute, publish, sell, or commercially use our website content, artwork, images, designs, text, or other materials without our prior written permission.
We reserve the right to restrict or suspend access to the website if we reasonably believe that these Terms have been violated or that the website is being misused.

We do not guarantee that the website will always be available, uninterrupted, or free from errors. We may update, modify, suspend, or discontinue any part of the website without notice.

We use trusted third party service providers to help operate our website and online store, process payments, produce and fulfill print on demand products, deliver orders, and provide other services necessary to operate our business.

These providers may have access to information needed to provide their services and may have their own terms, conditions, and privacy policies. Where applicable, your use of their services may also be subject to those terms and policies.

We are not responsible for the content, policies, availability, or practices of third party services that we do not control. However, we take reasonable steps to work with reputable service providers and expect them to handle information appropriately.

We make reasonable efforts to keep our website, products, and services accurate, reliable, and available. However, we cannot guarantee that the website will always be available, uninterrupted, or free from errors.

To the extent permitted by applicable law, House of Badia will not be responsible for losses or damages arising from circumstances beyond our reasonable control, including delays or disruptions caused by shipping carriers, print on demand providers, website or hosting services, payment providers, technical issues, or other third party services.

To the extent permitted by law, House of Badia will not be liable for indirect, incidental, or consequential losses arising from the use of our website or products.

Nothing in these Terms limits or excludes any rights, remedies, warranties, or liability that cannot legally be limited or excluded under applicable law.

We may update these Terms from time to time to reflect changes in our business, legal obligations, or website functionality.

Updated Terms will become effective when posted on our website unless otherwise stated. Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms. We will not apply material changes retroactively to orders already placed unless required or permitted by law.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

If you reside outside Ontario, including in the United States, you may have consumer rights under the laws of your place of residence. Nothing in these Terms limits or excludes any rights or protections that cannot legally be waived under applicable law.
